HTC Is Committed To Fight To The End, Apple Surprised With Another Lawsuit

Asia-phone maker refuses to submit to the moral power of Apple

Faced with an uncertain fate for the submission of license complete elimination of international markets, on top of Android handset manufacturer HTC Corp. (SEO: 066570) has promised to challenge Apple Inc (AAPL) at the end.

HTC Apple has continued in a variety of international jurisdictions [1] [2], asking local business organizations to temporarily prohibit the importation and sale of the popular HTC smartphones and tablets. If Apple wins lawsuit, the temporary supply to prevent competition could become permanent.

HTC this week at the fire, making a lawsuit against Apple, "HTC Corp. v. Apple Computer, Inc., a U.S. District Court, District of Delaware, No. 11-00715," which supports Apple iPad, iPhone, iPod, Mac and viola trio HTC has acquired the patent in 2008 and 2010.

The company seeks compensation for damages triple for Apple "willful" violations. The company said it would likely file a new complaint with the U.S. International Trade Commission, seeking to fight fire with fire, trying, once again, banning imports of products from Apple.

A few weeks ago HTC management has expressed its willingness to work with Apple for a fair and reasonable cross-licensing regime. Apparently, these negotiations have failed, either because the request for compensation from Apple were too exorbitant or because Apple is just hoping to use the court system to crush rivals.

The odds certainly seem stacked against HTC. Apple has many more patents - 3,000 U.S. patents, compared to 58 by last count [source], United States (this figure is probably gone a bit with the recent acquisition of S3 Graphics). Apple has a lot more money on hand to hire the elite legal representation, one of the advantages of being the most profitable in the world of high technology companies. And Apple has already won the first round in court for a preliminary determination, the single judge who is guilty of the violation of two Apple HTC has 20 patents.

However, HTC might impose vows to challenge Apple. Be willing to challenge his multiple claims against the Cupertino company to court. Is also expected to review December 6, 2011 appealing the original decision of the U.S. Trade Commission HTC smartphones found to invade Apple's intellectual property.

In short, if there is fear in the camp of HTC is probably not the show as she prepares to lock the legal weapons with Apple in a potential life or death struggle.

And support can be directed to HTC. Google Inc (GOOG), producer of the Android OS yesterday announced plans to acquire Motorola's Mobility, Inc. (MMI) to USD 12.5b. The agreement provides Motorola's war chest of 17,000 patents in general Android camp. In other words, if HTC could simply keep long enough for Apple, Google can come through the market and freedom can be preserved ..
